1. Acceptance of terms

By accessing or using fstlaunch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

fstlaunch is a platform that allows users ("Founders") to create referral-powered waitlists. End users ("Subscribers") sign up for those waitlists via public pages. The Service includes waitlist creation, referral tracking, leaderboards, embeddable widgets, and email notifications.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to collect data in violation of applicable laws
• Submit or distribute spam, malware, or fraudulent content through waitlists
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure
• Scrape, crawl, or harvest data from the Service without permission
• Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these terms.

5. Waitlist data & ownership

Founders retain ownership of the data collected through their waitlists. By using the Service, Founders grant fstlaunch a limited license to store, process, and display that data solely to provide the Service. We will not use Founder or Subscriber data for unrelated purposes.

6. Payments & subscriptions

Paid plans are billed through Stripe. Subscription fees are charged in advance on a monthly basis. The Lifetime deal is a one-time payment granting permanent access to the current feature set. Prices are subject to change with 30 days' notice.

Refunds: Monthly subscriptions may be cancelled at any time; no refunds are issued for partial billing periods. Lifetime purchases are non-refundable after 14 days.

7. Plan limits

Each plan has defined limits (e.g. number of waitlists, signups, features). If you exceed your plan limits, we may ask you to upgrade. We will not delete your data without notice.

8. Intellectual property

The Service, including its design, code, branding, and documentation, is owned by fstlaunch and protected by intellectual property laws. You may not copy, modify, or redistribute any part of the Service without written permission.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, fstlaunch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these terms. Upon termination, your right to use the Service ceases. Data deletion follows the timeline described in our Privacy Policy.

12. Changes to these terms

We may revise these terms at any time. Material changes will be communicated via email or an in-app notice at least 14 days before they take effect. Continued use after changes constitutes acceptance.
